Terms and Conditions

Aurixema Travel (“we”, “our”, “us”) is a trading name of Aurixema LTD, registered in England and Wales under company number 16530011.

General Terms and Conditions

These Terms and Conditions are applicable to all bookings made with Aurixema Travel. However, please note that some specific terms and conditions may apply to your particular booking, depending on the nature of the travel arrangements or services you select. These specific terms will be clearly communicated to you at the time of booking, and you will be required to accept them before your booking is confirmed.

By making a booking with us, you (“the client”) agree to the general Terms and Conditions outlined below, along with any additional or specific terms that apply to your particular travel arrangements.

1. Making Your Booking

  • Booking Process: To confirm your booking, please complete the booking form and submit it to us along with a non-refundable deposit of 20% of the total holiday cost or £250 per person (whichever is greater). Some tours may require a higher deposit; you will be informed at the time of booking.
  • Final Payment: The balance of the holiday cost is due no later than 10 weeks before departure. If booking within 10 weeks of departure, the full cost is payable immediately.
  • Confirmation: Upon receipt of your booking form and deposit, we will send you a confirmation invoice and further information relevant to your tour.

2. Prices and Surcharges

  • Pricing: All prices are based on tariffs, other costs, and exchange rates published in the Financial Times on the date of publication shown on the relevant itinerary.
  • Surcharges: The price of your travel arrangements may be varied due to changes in transportation costs, government action, or currency fluctuations. We will absorb or retain a variation equivalent to 2% of the price of your travel arrangements, excluding any amendment charges.
  • Cancellation Due to Price Increase: If a price increase exceeds 10% of the total holiday cost, you have the right to cancel your booking and receive a full refund, excluding any amendment charges. You must exercise this right within 14 days from the issue date printed on your final invoice.

3. Passports, Visas & Health

  • Responsibility: It is your responsibility to ensure you have a valid passport, relevant visas, and comply with health regulations required by the countries you will visit.
  • Assistance: We can provide information on passport and visa requirements and offer assistance in obtaining them. Health advice can be obtained from your GP or the Department of Health.

4. Alterations by Us

  • Changes to Arrangements: We will do our utmost to provide the tour arrangements confirmed. However, we reserve the right to modify or cancel any tour, flight schedule, accommodation, or arrangement due to unforeseen circumstances amounting to ‘force majeure’.
  • Notification: In such cases, we will inform you as soon as possible and offer an alternative tour or a full refund of all money paid.

5. Alterations by You

  • Request for Changes: If you wish to make alterations after confirmation, please notify us in writing. We will do our best to accommodate your request, subject to availability and payment of any additional costs.
  • Amendment Charges: If alterations are made less than 10 weeks before departure, an additional £50 per booking charge will apply, along with any communication costs incurred.

6. Cancellation by You

  • Right to Cancel: You or any member of your party may cancel your tour at any time, provided the cancellation is made by the person who signed the booking form and is communicated in writing.
  • Cancellation Charges: The following cancellation charges apply as a percentage of the total holiday price:

    • Transfer to Third Party: You may transfer your booking to a third party who satisfies the conditions required to take the tour. We will retain your deposit to cover administration costs and pass on any additional fees levied as a result of the transfer.

    7. Our Liabilities

    • Responsibility: We do not exclude or limit any liability to our clients which may arise from proven negligence by any person employed directly by us or by our suppliers and subcontractors, servants, or agents of the same whilst acting in the course of their employment.
    • Limitations: Our obligations and responsibilities shall be limited to where international conventions in respect of air or sea carriers apply. We cannot assume responsibility for loss or expense due to war, riots, strikes, terrorist activities, or natural disasters.

    8. Travel Insurance

    • Requirement: It is imperative that you take out adequate travel insurance to our reasonable satisfaction. We will require you to provide evidence of your insurance at least 8 weeks prior to departure or at the time of booking if later.
    • Termination of Booking: We reserve the right to terminate your booking if you fail to obtain travel insurance cover.

    9. Complaints & Arbitration

    • On-the-Spot Resolution: We will always endeavour to resolve any complaints on the spot. However, if the matter cannot be resolved, you must write to md@aurixema.com, Managing Director, within 14 days of the end of the tour.
    • Arbitration: In the unlikely event that the problem is not amicably resolved, the case may be referred to arbitration under a special Scheme arranged by the relevant industry body or in accordance with the laws of the UK.

    10. Data Protection

    • Privacy: We are committed to protecting your personal data. By making a booking, you consent to the use, processing, storing, transferring, and disclosing of your information as outlined in our Privacy Policy.
    • Sharing Information: Your information may be passed on to relevant suppliers of your travel arrangements, public authorities such as customs or immigration if required by them or by law, and security or credit checking companies.

    11. Financial Protection

    • Since we are not members of ATOL or ABTA, we do not provide financial protection for your holiday arrangements in the same manner. However, we ensure that:
    • Travel Insurance: We strongly recommend that you take out comprehensive travel insurance to protect against potential risks, such as trip cancellation, medical emergencies, or loss of personal items during your holiday.
    • Liability: We are committed to ensuring the safety and security of all travel arrangements. However, please be aware that our services do not include any form of statutory financial protection unless explicitly stated in your travel agreement.

    12. Governing Law

    • Jurisdiction: These terms and conditions are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the English courts.
